Publication schedule

Documents appearing in the Register are published in accordance with the following schedule:

DOCUMENTS	PUBLICATION SCHEDULE
Text of emergency rules	No earlier than 8:00 a.m. nor later than 5:00 p.m. on the next business day.
Public hearing notices for rules proposed under R.C. Chapter 119.	No earlier than 8:00 a.m. nor later than 5:00 p.m. on the next business day.
Revised and refiled filings of proposed rules	No earlier than 8:00 a.m. nor later than 5:00 p.m. on the next business day.
All other documents appearing in the Register (see About the Register)	As soon as practicable depending on the volume of filings received by LSC, but no later than 12:00 noon on Wednesday of the week following the documents' filing.

Register deadlines are strictly adhered to.

Purgation schedule

Ohio Revised Code section 103.051 requires LSC "to purge a document from the Register when its display no longer serves the public notice and information functions performed by the Register." The LSC policy for purging documents from the Register is as follows:

(1) The text of an emergency rule will be purged 91 days after the rule takes effect. (An emergency rule normally expires on the 91st day after it takes effect unless, in the meantime, the agency has readopted the rule according to the normally applicable rule-making procedure.)

(2) The public hearing notice associated with a proposed rule will be purged from the Public Hearing Notice Bulletin Board after the scheduled public hearing date has passed. However, the notice will remain accessible along with other rule-making documents associated with the rule, for as long as the rule is published in the Register, through the screen displaying the most recent filing information for that rule.

(3) The text and RSFA of a proposed rule will be purged when the next filing action for that rule is published, and will be replaced with the text and RSFA associated with that next action.

(4) The text and RSFA of a proposed rule that an agency has withdrawn from the rule-making process will be purged 90 days after the rule is withdrawn, or when another action is taken on the rule.

(5) The text and RSFA of a final filed rule that an agency has withdrawn will be purged when the next action is taken on the rule, and will be replaced with the text and RSFA associated with that next action.

(6) The text and RSFA of a rule that has been placed in "To Be Refiled" status will be purged when the next action is taken on the rule, and will be replaced with the text and RSFA associated with that next action.

(7) The text and RSFA of a rule that is filed as a no-change rule after cyclical review under Ohio Revised Code section 119.032(E)(2) will be purged 90 days after the rule is filed.

(8) The text of an adopted rule, and the rule-making documents associated with it, will be purged 365 days after the rule is filed in final form. (However, documents associated with an adopted rule will be purged sooner if an amendment or rescission of the rule is proposed before 365 days have passed.)

(9) The text of an Ohio EPA final filing notice will be purged 60 days after it is filed with LSC.

(10) The text of a Medicaid final filing notice will be purged 60 days after it is filed with LSC.

(11) The text of an Agricultural Commodity Marketing Program notice filed by the Ohio Department of Agriculture will be purged 60 days after it is filed with LSC.

Rule history since July 2000

Some documents purged from the Register will temporarily become available again as part of the Register's rule history feature. For as long as the Register publishes current information about a rule, it also will make available the history of that rule number, and the associated rule-making documents, since July 2000. This history is accessible through a link at the bottom of the screen displaying information for the individual rule number. It is not available for rules that are not currently published in the Register.

LSC will offer this history feature as a public service for as long as available disk space allows. However, as technical needs dictate, there likely will be a future policy limiting the extent to which historical documents are available through the Register.
